TERMS AND CONDITIONS

Agreement Overview

 

 

 

This agreement contains the entire understanding between the Photographer/Videographer and the Client. It supersedes all prior and simultaneous agreements between the Parties. The only way to add or change this agreement is to do so in writing, signed by all the Parties. If the Parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

RETAINER

Minimum of 50% (RETAINER) is required to reserve the date and time of the event, 50% of total payment due on or before day of Videography/Photography cannot be delivered unless payments due have been paid in full. Payments for additional services/albums are due upon ordering of those items. RETAINERS ARE NON-REFUNDABLE if the event is cancelled. If postponed prior to the date, Roc Media
Production may film if the new date is available. Roc Media Production will apply retainer to the new agreement. Delivery of photos/video are within 8-10 weeks of day of event.

 

PHOTOGRAPHY/ VIDEOGRAPHY

 

It is agreed that the following terms set out the total agreement made between the
parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

 

IMAGES

 

The Photographer/Videographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record the exact colour as seen by the human eye.

RETOUCHING

 

Roc Media Production will retouch, digitally manipulate and finish according to their discretion. Any retouching, digital manipulation or finishing which is requested by the client(s) may be subject to an extra charge at the discretion of Roc Media Production.

 

ATTENDANCE

 

In the unlikely event of the assigned photographer/ videographer being unable to attend the agreed wedding due to unforeseen circumstances, ROC MEDIA PRODUCTION reserves the right to appoint another photographer/videographer to
attend your wedding on our behalf to undertake the wedding to the best of his/her ability. In the unlikely event of a total failure or cancellation of contract by either party in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect of consequential loss.

 

CANCELLATION

 

The due performance of this contract is subject to alteration or cancellation
by either party owing to any cause beyond their control. The client may cancel this contract at any time by giving written notice to ROC MEDIA PRODUCTION but in doing so shall forfeit any monies already paid. Cancellation less than SEVEN DAYS before the wedding date will result in payment in full by the client for the agreed package.

 

DIGITAL FILES

Digital files remain the property of the Roc Media Production. Roc Media Production will not be solely responsible for the storage and maintenance of digital files, but will keep digital files intact and available to the client for at least one year from the date of the wedding.

WEBSITE DISPLAY

 

Photographs and video footage from a client's wedding may be displayed on the Roc Media Production website if requested.

 

COMPLAINTS

Any complaints should first be raised by the client to Roc Media Production within 10 days from the receipt of photos/video.

 

RECEPTION

 

Food beverage service shall be provided to Roc Media Production during reception.
